Can I make a Section 75 claim against my credit provider?
The Credit Consumer Act is used as a framework for reclaiming your money. Under Section 75 of the Consumer Credit Act 1974, it states that credit card companies jointly liable for any breach of contract or misrepresentation of a product sold.
Section 75 of the Consumer Credit Act also applies to foreign transaction as well as goods purchased online, by phone or by email from over seas.
This means the lender is just as responsible as the retailer or trader for the goods or service supplied, allowing you to also put your claim to the financial/credit card company.
REST ASSURED SECTION 75 covers the whole purchase, even if you paid
only part of the cost on the card and the rest by other means.
SECTION 75 can be used if the resort/company has gone bust or
doesn’t respond to your letters or phone calls.
SECTION 75 protects you on product purchases as well as covering you on Services purchased, If you have found yourself in a situation where a company has charged you to relinquish your timeshare and the service has not been completed, you may also be able to claim this money back.
LIMITATIONS – To make a claim you must have spent over £100 and no more than £30,000 on your credit card
If you feel unhappy with the credit providers reply or the outcome of a complaint to the Financial Ombudsman Service, you have a total of six years to pursue the matter in court.
